TRAINING PROGRAM ORGANISED BY MOMENTUM TRADING ACADEMY ("MMTTA")
In consideration of my participation in the Training, I hereby agree to the following terms and conditions:
1. DISCLAIMER & WAIVER OF CLAIMS
a) I acknowledge that any investment, business or other activity I undertake following the Training can involve a significant degree of risk and that I may incur financial losses if I engage in such activity. I acknowledge that the Training is purely educational in nature and that it is designed and intended to teach participants about the subject of the Training, but that the Training does not guarantee any investment, trading or business performance or rate of return or other result.
b) I acknowledge and agree that all content in the Training and in any related materials, including information contained in the any of the materials provided and any examples presented, is for educational purposes only and does not constitute either investment advice or a recommendation to buy, sell or otherwise participate in any particular investment, financial instrument or business activity. I acknowledge that WM and its employees, officers, representatives or trainers are not stockbrokers, brokers, dealers, or investment advisors, that they make no recommendation either to acquire, become otherwise involved with or sell any particular stock, bond, option, financial instrument, security or business of any kind, that any mention of a particular stock, bond, option, financial instrument, security or business opportunity in the Training is made only for educational and illustrative purposes and that no training content, example, information or material shall be construed as a recommendation, solicitation, prediction, or advice for my own actions in or dealing in any investment, financial instrument or business of any kind.
c) I acknowledge and agree that any investment, trading or business activity that I may conduct in stocks, bonds, options, financial instruments, other securities or business opportunity shall be my sole decision and at my sole risk. I hereby release MMTTA and it employees, officers, representatives or trainers, from any and all liability resulting from any investment, trading or business activities" that I may conduct in the potentially high-risk investment, trading or business environment using techniques taught in the Training. I hereby agree to indemnify and hold harmless MMTTA and its employees, officers, representatives and trainers from any claim, action, loss or damage, including attorneys' fees, arising out of my personal activity within such potentially high-risk investment, trading or business environments.
d) I acknowledge and agree that MMTTA excludes all liability for consequential damage (including, but not limited to, lost revenue, lost profit or lost investment) suffered by me in any way relating to the Training or my exercise of rights under this Agreement.
2. CONFIDENTIALITY AND COPYRIGHT
a) I acknowledge that all content, workbooks, materials, and systems used in or taught at the Training, whether written or verbal, are proprietary to MMTTA and/or its trainers and are the subject of international copyright.
b) I agree that I shall not duplicate, give, lend, provide, make available or divulge to any unauthorized person any of the materials, notes, systems, or teachings of the Training, whether for financial gain or otherwise.
c) I agree that I shall not photograph, photocopy, or make any audio or video recording of the Training or any materials provided except with MMTTA's prior written consent.
3. RELEASE
a) I consent to MMTTA's use of my name, voice, photograph and/or likeness in photographs and/or audio or video recordings of the Training in which I participate. I agree that MMTTA shall be the sole owner of all right, title and interest in and to such photographs and recordings (including, without limitation, all worldwide copyrights therein), for all purposes, free from any claim whatsoever by me or any person deriving any right or interest from me. I further consent to MMTTA's use for testimonial purposes of statements made by me during the Training or in any customer survey or correspondence subsequent to the Training.
b) I consent to MMTTA passing my personal details to external organizations for the purposes of me opening a demonstration account in my name.
c) I acknowledge that MMTTA may receive remuneration for introducing me to an organization with whom I register as a client.
4. REFUND
4.1. Clause is only applicable to e-Learning.
a) Online e-Learning "User ID" and "Password" will only be issued to client making Full & Completed Payment.
b) Once the client Login using MMTTA provided "User ID" and "Password", the client will not be entitled to any Refund.
c) Should the client have any technical difficulty Login in the "User ID" and "Password" to access/enter the online e-Learning content, the client will have to contact MMTTA within 3 working days from the Date of Full Payment or Enrolment to receive a new set of "User ID" and "Password".
d) Refund is only applicable to Deposit or Part Payment.
e) E-Learning "User ID" and "Password" will Not be issued for any Deposit or Part Payment.
f) The client will be entitled to a refund of the Deposit or Part Payment if the client notifies MMTTA in writing within 7 days.
